- STATE ASSEMBLY INTRODUCES LEGISLATION ON
PHYSICIAN DISCIPLINE PROCESS
Legislation (A.11330) was introduced by Assemblyman Richard Gottfried to
address concerns raised by attendees of an Assembly hearing on Physician
Discipline held earlier this year. Among other things, the bill would:
- establish a statute of limitations for OPMC proceedings;
- increase the evidentiary burden of proof to a clear and
convincing standard;
- establish additional due process protections for physicians
under investigation;
- require the proffering of exculpatory evidence;

MSSNY COMPLETES REVIEW OF GOTTFRIED PHYSICIAN
DISCIPLINE BILL (A.11330)
This week, MSSNY completed its review of Assemblyman Gottfried's proposal to
modify the existing physician discipline process (A.11130-A).

express its support for several provisions contained in the bill, and its
